By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not access or use Blindly.
1. Eligibility & Account Creation
- Age Requirement: You must be at least 18 years of age to create an account or use Blindly. By using the Platform, you represent and warrant that you meet this requirement.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- One Person, One Account: Accounts are personal and non-transferable. You agree not to create accounts on behalf of anyone else or sell/transfer your account to another party.
2. Platform Concept & Mechanics
- Identity Protection: Blindly is designed to protect your profile structure and personal identity until both you and another member mutually consent to reveal your profiles.
- Location Processing: Blindly uses generalized location data to show nearby active members as unexposed nodes. You acknowledge that location features are intended for real-time proximity matching and approximate map representations.
3. Community Standards & Acceptable Conduct
Blindly is built on mutual respect, real people, and safe dialogue. By using the Platform, you agree NOT to:
- Harass or Harm: Engage in harassment, stalking, hate speech, bullying, threatening behavior, or intimidation.
- Fake Identity & Catfishing: Use fake photos, misrepresent your identity, or bypass our liveness verification systems.
- Commercial Activity & Spam: Use the Platform for advertising, solicitation, commercial promotions, selling services, or spamming other members.
- Inappropriate Content: Share or request explicit, illegal, sexually aggressive, or non-consensual content.
- Automated Tools: Use bots, scrapers, crawlers, or unauthorized tools to access data or manipulate the Platform.
4. Safety & Account Suspension
- Enforcement & Bans: We reserve the right to investigate reports and temporarily or permanently suspend any account that violates these Terms or our Community Guidelines. Violations involving harassment, commercial activity, or catfish profiles lead to immediate and permanent verification suspension.
- Safety Features: While we enforce safety by architectural design and liveness verification, you acknowledge that no online interaction is 100% risk-free. Always exercise caution and common sense when interacting with other users.
5. Subscriptions & In-App Purchases (If Applicable)
- Billing: Certain premium features, passes, or boosts may require purchase. All charges will be clearly displayed before completing a transaction.
- Refunds: All purchases are non-refundable to the extent permitted by local applicable laws, except as explicitly stated in app store policies (e.g., Apple App Store or Google Play Store rules).
6. Intellectual Property
- Our Rights: All rights, titles, and interests in the Blindly app, branding, design, logos, and underlying software code belong exclusively to Blindly.
- Your Content: You retain ownership of any text, messages, or content you upload to the Platform. However, by posting content, you grant us a worldwide, royalty-free license to host, store, and process that content strictly for the operation of the Platform.
7. Disclaimers & Limitation of Liability
- "As-Is" Service: Blindly is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
- Limitation of Liability: To the maximum extent permitted by law, Blindly and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your access to, use of, or inability to use the Platform, or the conduct of other users.
8. Termination
You may terminate your agreement with Blindly at any time by deleting your account inside the app settings and ceasing all use of the Platform. We reserve the right to modify, suspend, or terminate the Platform or your access to it at any time, with or without notice, if you breach these Terms.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Blindly operates, without regard to its conflict of law principles. Any legal action or dispute arising from these Terms will be resolved through binding arbitration or the local courts of competent jurisdiction.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via an in-app notice or email before the changes take effect. Your continued use of Blindly after the updates become effective constitutes your acceptance of the new Terms.
